Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HeDonist mobile application, website, and related services (collectively, the “Service”) provided by VaultPulls Limited (“Company,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1. Eligibility and Age Requirement

1.1 You must be at least 21 years of age to use the Service.

1.2 By using the Service, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into these Terms.

1.3 We reserve the right to request proof of age at any time. Failure to provide satisfactory proof may result in immediate termination of your account.

2. Account Registration and Security

2.1 You must register an account to access most features of the Service.

2.2 You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

2.3 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.4 You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3. User Content and License

3.1 Definition: “User Content” means any content you submit, post, upload, or transmit through the Service, including but not limited to text, photos, videos, voice notes, tags, and location data.

3.2 License Grant: By submitting User Content, you grant HeDonist a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, display, reproduce, modify, create derivative works, and distribute your User Content in connection with operating and improving the Service.

3.3 Public vs Private Content:

  • Content posted publicly may be viewed by other users.
  • Content saved in Secret Mode (Private Logs) is intended to be visible only to you. However, you acknowledge that no system is completely secure, and we cannot guarantee absolute privacy.

3.4 You represent and warrant that:

  • You own or have the necessary rights to the User Content you submit.
  • Your User Content does not violate any third-party rights or applicable laws.

4. Prohibited Conduct

You agree not to:

  • Post, upload, or transmit any content that is illegal, harmful, abusive, harassing, defamatory, obscene, or hateful.
  • Post content involving minors, non-consensual intimate imagery, or promotion of illegal activities.
  • Harass, threaten, or bully other users.
  • Impersonate any person or entity.
  • Use the Service for any commercial purpose without prior written approval.
  • Attempt to reverse engineer, decompile, or extract the source code of the Service.
  • Interfere with or disrupt the Service or servers.
  • Violate any applicable laws or regulations.

We reserve the right to remove any content and suspend or permanently terminate accounts that violate these rules, at our sole discretion.

5. Content Moderation

5.1 HeDonist reserves the right (but has no obligation) to monitor, review, and remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

5.2 We may take action against accounts that repeatedly violate these Terms, including permanent suspension.

6. Intellectual Property

6.1 All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of HeDonist and its licensors.

6.2 You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Termination

7.1 We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

7.2 Upon termination, your right to use the Service will immediately cease. Sections 3, 6, 8, 9, and 10 shall survive termination.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content or recommendations will be accurate or reliable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEDONIST AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY;
  • UNAUTHORIZED ACCESS TO OR USE OF YOUR DATA;
  • ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE.

10. Indemnification

You agree to defend, indemnify, and hold harmless HeDonist, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your use of the Service;
  • Your violation of these Terms;
  • Your violation of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong.

Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation. If negotiation is unsuccessful, disputes shall be resolved in the courts of Hong Kong.

12. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes through the App or by email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
